Man Faces 2 Years For Punching Elderly Costco Shopper Over Nutella Samples

Derrick Gharabighi, 24, pleaded no contest to one count of elder abuse for the assault, prosecutors said.

A California man faces up to two years in prison after pleading no contest Friday to punching a 78-year-old man who told him he had taken too many Nutella samples at a Costco.

Derrick Gharabighi, a 24-year-old Burbank resident, pleaded no contest to one count of elder abuse, according to the Los Angeles County district attorney's office.

According to authorities, when the elderly man reached out to take Nutella waffle sample in September, Gharabighi took all of them, prosecutors said.

When the older man told Gharabighi he had taken too many, Gharabighi punched him in the face, prosecutors said.

The man was taken to a hospital for treatment, and Gharabighi was arrested by Burbank police.

Gharabighi is scheduled to be sentenced next year.
